Severance Pay 2026: How Much, Taxes & How to Negotiate

Short answer

Severance pay isn't required by the FLSA. Compare typical packages, 2026 taxes, unemployment rules in 8 states, and email and phone scripts to negotiate more.

The calendar invite said "Quick sync." HR was already on the call when you joined.

Now you have a Separation Agreement, a deadline, and a number. Maybe it's 8 weeks of pay. Maybe it's 2. You have no idea whether that's generous or exactly what everyone else got.

The signature page asks you to release legal claims. The clock is running, and the number alone doesn't tell you what this deal is worth.

What is severance pay?

Severance can be a negotiated deal or an obligation your employer already owes. Find out which before judging the offer.

The U.S. Department of Labor says the Fair Labor Standards Act has no severance requirement. That does not override a contract, a benefit plan or a state-law obligation.

When an employer has to pay severance

"Voluntary" stops being voluntary once it's promised. An employer can owe you severance when:

  • A plan, policy or employment agreement promises it. Eligibility conditions still matter. Texas TWC says severance promised in a written policy or agreement is enforceable under the Texas Payday Law. Illinois DOL also recognizes promised severance. Federal EBSA may help with benefits required by an employment contract.
  • A union contract (collective bargaining agreement) sets it.
  • New Jersey's WARN law applies. Covered employers with 100+ employees must pay one week per full year of employment for covered layoffs and shutdowns. Coverage depends on more than employer size, including the establishment and number of terminations. The state's WARN notification form explains those conditions. Find the document before you negotiate

Ask HR for the plan, policy or contract clause and the calculation used for your offer. Check eligibility, credited service, minimums and caps.

There's no national rate. A benchmark helps compare an offer, but your plan sets the amount.

LHH and Compensation Resources surveyed 685 U.S. HR leaders for their 2020 study. It is historical employer data, not a representative average of all workers' payouts in 2026.

These published formulas show how packages can differ. Meta and Google are historical U.S. offers, not their current policies. The Google layoffs page tracks the different buyout terms reported since 2023.

How to calculate your severance pay

A severance pay calculator is only useful if it follows your employer's formula.

Step 01: Find your weekly base pay

A $78,000 annual salary divided by 52 is $1,500 a week. Check whether the plan includes bonus or commission.

Step 02: Count your years of service

Use the plan's rule for partial years. OPM adds 25% of the applicable annual amount for each full 3 months beyond the last full year.

Step 03: Apply the formula, then the floor and the cap

Multiply, add any fixed base award, then apply the plan's minimum and maximum.

CMS's COBRA fact sheet explains that COBRA generally covers employer group health plans with 20+ employees in the prior calendar year. Job loss other than for gross misconduct normally allows up to 18 months of continuation coverage. The DOL Health Benefits Advisor explains the election period: at least 60 days from coverage loss or the election notice, whichever is later. CMS's May 2026 guide confirms the job-loss rules and premiums of up to 102% of the total plan cost, including the employer's former share.
For incentive stock options, IRC section 422 generally requires exercise within 3 months after employment ends to retain ISO tax treatment, with a 1-year rule for qualifying disability. A longer exercise window is not automatically a tax extension.
COBRA isn't your only option
HealthCare.gov says to apply within 60 days of losing job-based coverage. Compare Marketplace coverage and any income-based premium tax credits with the COBRA price.

The severance agreement: what you sign away

Here's the trade most people miss: severance is usually not a gift. It's payment for a promise not to sue.

The EEOC explains that a release needs consideration: something of value beyond existing entitlements. Earned vacation pay or pension benefits already owed cannot be the payment for that waiver.
General information, not legal advice

A release can be broad, but it has limits. According to the EEOC:

  • You can still file a charge with the EEOC, and no agreement can stop you from testifying or participating in an EEOC investigation. A clause that tries is unenforceable.
  • You can't be required to return severance pay before filing an EEOC charge.
  • A valid waiver can't cover claims that arise after you sign.

Have a lawyer check how the agreement affects unemployment, wage and retirement rights. Those issues require their own legal review.

Extra protections if you're 40 or older (OWBPA)

For employees 40+, the Older Workers Benefit Protection Act (OWBPA) sets minimum rules for waiving Age Discrimination in Employment Act (ADEA) claims. These periods concern an age-claim waiver, not every severance offer.

In a covered group program, the employer must disclose the decisional unit (the group from which selections were made), eligibility factors and time limits. It must provide job titles and ages of those eligible or selected, plus ages of those in the same job classifications or organizational unit who were not eligible or selected. Broad age bands do not satisfy the requirement.

Details that trip people up
  • The review clock runs from the final offer. Material changes normally restart it, but the parties can agree otherwise. Confirm the deadline in writing
  • Early signing must be knowing and voluntary. The employer cannot induce it by threatening to withdraw the offer early or offering better terms for early signing
  • State law may add protections. The federal 7-day revocation period cannot be shortened

Is severance pay taxable?

Yes. But what gets withheld from the check isn't necessarily what you'll owe.

The IRS's 2026 Publication 15 treats severance as supplemental wages subject to income tax withholding, Social Security and Medicare.
How severance is withheld in 2026
  • Federal income tax: the optional 22% method requires separately identified supplemental wages and income tax withheld from regular wages in the current or preceding calendar year. Otherwise, payroll uses the aggregate method
  • Above $1 million: 37% withholding applies to the excess annual supplemental wages, including other supplemental payments from the employer and businesses under common control
  • Social Security: 6.2% on wages up to the 2026 wage base of $184,500
  • Medicare: 1.45% on all wages, plus 0.9% Additional Medicare Tax withheld on wages the employer pays above $200,000 in a calendar year
  • State and local income tax: depends on where you live and work
Illustration: if payroll uses 22%, the entire $30,000 payment remains below the Social Security wage cap, and no Additional Medicare withholding applies, deductions are $6,600 federal income tax, $1,860 Social Security and $435 Medicare. That leaves $21,105 before state tax or other deductions. If earlier wages used up part of the wage cap, the Social Security deduction changes.

Your tax return reconciles withholding against the tax owed on total annual income. A refund or additional payment is possible; 22% is not a special final tax rate for severance.

Two tax moves worth asking about
Ask a tax professional whether payment timing affects your situation. Unemployment compensation is also federally taxable: IRS Publication 4128 explains the option to request 10% withholding with Form W-4V.

Pennsylvania illustrates the calculation: $35,000 minus $28,153.63 leaves $6,846.37 deductible. At a $1,100 weekly wage, $1,100 is allocated to each of the first six weeks and $246.37 to week seven. Benefits depend on the remaining weekly entitlement.

How to find your state's rule

Search your state agency's claimant handbook for severance, salary continuation and pay in lieu of notice. Keep the agreement and payment schedule ready when applying. Report payments as the agency instructs; the label on HR's paperwork does not decide eligibility.

New Jersey advises filing immediately after full-time work ends, even while receiving severance. New York advises filing when uncertain and notifying its claims center promptly if a payment arrives within 30 days. Do not wait for the cash to run out before checking how to file.

WARN Act pay in lieu of notice vs severance pay

If you were part of a big layoff and got "60 days of pay," check what that money actually is.

The federal WARN Act normally requires covered employers to give 60 days' written notice of covered plant closings or mass layoffs. Coverage and exceptions matter; a large layoff does not automatically qualify.

The DOL WARN Advisor explains that pay does not replace the notice requirement. A violation can create back-pay and benefit liability for the missing notice period, up to 60 days. Qualifying voluntary payments can offset that liability; payments already required by a contract or policy cannot simply be counted as that offset.

New Jersey's covered events require 90 days' notice and one week of severance per full year of employment. Insufficient notice adds four weeks of severance. Ask HR to separate federal WARN payments, state-law severance and any additional package in writing.
