OPT Unemployment Days: The 90 and 150-Day Rules

Short answer

OPT unemployment days explained: count gaps correctly, understand the 90 and 150-day limits, document qualifying work, and check next steps in October 2026.

An offer email can feel like the finish line. Your first day may still be weeks away.

For an international graduate, the gap between those dates matters. So does the gap between what actually happened and what your school record says happened. Keep both visible before another recruiting process drifts.

Legal information checked October 15, 2026. General information, not legal advice. Confirm your status, work permission and deadlines with your DSO or a qualified immigration attorney.

The 90-day limit and the combined 150-day limit

The STEM extension does not erase unemployment already used. Under 8 CFR 214.2(f)(10)(ii)(E), checked October 15, 2026, post-completion OPT has a 90-day aggregate unemployment limit. A student granted the qualifying 24-month STEM extension may accrue no more than 150 days over the total OPT period, including the initial period.
StageUnemployment limitWhat carries forward
Initial post-completion OPT90 aggregate daysAll unemployment gaps in that period
Initial OPT plus an approved STEM extension150 aggregate days combinedThe initial OPT days already used
The source for both rows is the current regulation. The additional allowance associated with STEM does not let an initial-OPT student exceed the initial limit while merely planning to apply for STEM.
Arithmetic illustration: If a student used 40 unemployment days during initial OPT, a granted STEM extension leaves 110 within the combined allowance: 150 minus 40. This is an example derived from the regulation, not an individual status assessment.
Use the OPT unemployment-days calculator to assemble a working count. Take the employment dates and any uncertainty to the DSO before making decisions from that number.

When the unemployment clock starts

Graduation day and OPT employment authorization are different reference points. DHS's Unemployment Counter, updated July 27, 2026, says SEVIS looks back to the actual OPT start date and counts days without employer information.

That makes accurate employment entries essential. Do not begin the calculation from the date you received the physical card, the date you noticed a portal message or the date the first recruiter replied. If an approval delay or a changed start date creates ambiguity, ask the DSO to check the actual authorized period in your record.

Record the first day qualifying work actually begins. A future-dated offer does not fill the intervening gap with employment. An application, interview, background check or verbal assurance is also not a substitute for work. Sources: DHS counter and the employment-dependent OPT rule.

A useful personal record contains:

  • OPT authorization start and end dates.
  • Each employer's legal name and actual start and end dates.
  • Hours, duties and the connection to the qualifying degree.
  • Dates reported to the school, plus confirmation of corrections.
  • Offer letters, pay records and evidence of actual work.

Treat the record as evidence you can reconcile, not a second unofficial immigration database.

Weekends, gaps between jobs and overlapping employment

A calendar gap can contain more days than your intuition suggests. SEVIS's counter uses employment date coverage, rather than counting only the weekdays on which a student hoped to work. Source: DHS Unemployment Counter, July 27, 2026.
Hypothetical gap: A job ends on a Friday and the next qualifying job begins the following Monday. The intervening weekend is outside both employment periods. In contrast, an ordinary weekend during a continuing qualifying employment period is not automatically a new unemployment gap. Confirm unusual leave, furlough or reduced-hours arrangements with the DSO rather than extrapolating from this example.
For overlapping jobs, build one calendar of covered dates. Do not subtract the same calendar day twice because there were multiple employers. The legal test still includes whether the work qualifies; two questionable entries do not become valid employment by overlapping. Source: aggregate limit in 8 CFR 214.2(f)(10)(ii)(E).

Use a simple gap ledger:

GapLast covered employment dateNext qualifying start dateEvidence to retain
Before the first jobActual OPT start is the referenceActual first day workedEAD, approval and offer documents
Between employersEnd date confirmed by prior employerStart date confirmed by new employerSeparation and onboarding records
After a layoffActual end of qualifying workUnknown until work beginsEmployer and school correspondence

Do not enter an invented start date to make a dashboard look safe.

What counts as qualifying initial OPT employment?

A role title alone does not answer the question. OPT work must directly relate to the major area of study. A data-science graduate should be able to explain the actual analysis, programming or research duties and their connection to the degree. Source: 8 CFR 214.2(f)(10), checked October 15, 2026.
SEVP's April 23, 2010 OPT guidance describes qualifying initial post-completion OPT work, including the at-least-20-hours-per-week standard and certain unpaid arrangements that comply with labor law. That older guidance contains historical STEM provisions; use the current regulation and later STEM rule for STEM requirements, not its superseded extension details.
An unpaid internship is not a universal emergency solution. Get the duties, supervision, hours and dates reviewed. The March 11, 2016 STEM rule distinguishes initial OPT flexibility from the stricter STEM training and compensation requirements.
Degree-relationship worksheet:

Degree and major: [exact program]. Role: [actual title]. Duties: [specific tasks]. Relevant coursework or methods: [connection]. Evidence: [supervisor description or project documents].

Use your own facts. “This job is related to technology” is less useful than explaining how the work uses the degree's methods. Your school can tell you how to document the relationship in its reporting process.

STEM OPT requires more than finding any job

The extension adds employer conditions. The employer must participate in E-Verify in good standing, and the student and employer must complete the required training plan. The regulation also sets training, compensation and minimum-hours conditions. Source: 8 CFR 214.2(f)(10)(ii)(C), checked October 15, 2026.
A company that accepts an initial OPT employee may be unable or unwilling to support the STEM arrangement. Ask before the initial authorization is close to ending. The E-Verify employers for STEM OPT guide gives a screening process, including the distinction between an employer's E-Verify identification and its tax identification.
When an employment arrangement changes, ask who will sign the training plan, supervise the work and document evaluations. A letter offering to keep your record active while providing no real training is a warning sign. Paper entries cannot replace the qualifying employment required by the current rule.
Keep the employer pipeline eligible
Search companies with H-1B sponsorship history and cap-exempt H-1B opportunities for longer-term possibilities. Neither category automatically proves a role meets STEM OPT requirements.

Report changes and correct the record promptly

Your personal spreadsheet and SEVIS should tell the same story. DHS's OPT employer reporting instructions, updated April 28, 2025, describe student portal reporting and DSO corrections. Changes the student cannot or does not report through the portal must be reported to the DSO within 10 days.
STEM has additional reporting obligations. Under 8 CFR 214.2(f)(10)(ii)(C)(6), the employer must report an early departure or termination to the DSO within five business days. That employer obligation is separate from your own responsibility to report changes.
Message to the DSO:

Please help reconcile my OPT employment record. My authorization dates are [dates]. My actual employment periods are [periods], and I reported them on [dates]. The record appears to show [difference]. Attached are the supporting documents. Please confirm the count, any correction needed and any immediate action I should take.

Do not assume an empty dashboard is harmless. Equally, do not assume a counter proves a legal violation when employment was real but reported incorrectly. Ask for a factual reconciliation and preserve the response.

What to do when the remaining allowance is low

Bring the situation to your DSO now. If the allowable period may already have been exceeded, involve qualified immigration counsel rather than waiting for a portal warning. The regulation ties post-completion F-1 status to employment and limits unemployment; an apparent lack of enforcement is not extra permission. Source: 8 CFR 214.2(f)(10)(ii)(E).

Separate the legal decision from the application workflow. For the search, prioritize real, degree-related openings whose employer can answer authorization questions, prepare for active interviews and clear onboarding requirements. For status, ask the DSO or counsel about your actual options and timing. A planned school transfer or change of status should never be described as completed before it is.

October 2026 update: DHS published a fixed-admission final rule on July 17, 2026, scheduled for September 15. The September 14 order in Presidents’ Alliance v. DHS, pages 11 and 48 postponed the effective date under APA section 705 pending final resolution on the merits. It denied the requests for vacatur, summary judgment and other relief without prejudice. This describes that dated order, checked October 15, 2026, rather than the outcome of later proceedings. Ask the DSO to check subsequent orders and current school guidance against your I-94, I-20 and OPT authorization.
For broader planning, start with jobs for international students in the USA. The OPT application service describes delegated search support; it does not replace school reporting or legal advice.

Do not mix the OPT clock with the H-1B clock

The H-1B layoff grace period and OPT unemployment allowance come from different rules. F-1 is not among the classifications listed in 8 CFR 214.1(l)(2). A student cannot add an H-1B grace period to initial OPT unemployment merely because a future employer may sponsor a petition.
Read the H-1B grace-period guide and use the H-1B date tool only when that status is actually relevant. If a spouse's work permission becomes an option, the H-4 EAD jobs guide and H-4 service page explain the search context. The label on the job board never determines your immigration category.
Before you apply
  1. 01Keep a dated employment ledger and reconcile it with the DSO.
  2. 02Confirm degree relevance and employer requirements before counting a job as qualifying work.
  3. 03Treat a low balance as a reason for prompt school and legal review, not a reason to buy paper employment.
FAQ

Does STEM OPT reset unemployment days?

No. The combined allowance is 150 days across initial post-completion OPT and the granted STEM extension, including unemployment already used. 8 CFR 214.2(f)(10)(ii)(E), checked October 15, 2026.

Does a volunteer position stop unemployment?

Some initial OPT unpaid arrangements can qualify if the actual work meets OPT and labor-law conditions. STEM has stricter employer, training and compensation rules. Ask your DSO to review the actual arrangement. 2016 DHS final rule.

Can a calculator confirm that I maintained status?

No. A date calculator cannot determine whether employment qualifies or correct SEVIS. DHS describes a record-based counter; your DSO should reconcile the actual history. DHS counter.
