H-1B 60-Day Grace Period: Layoff Plan for 2026

Short answer

H-1B 60-day grace period after a layoff: confirm your deadline, plan a transfer, and understand the 2026 proposals and $100,000 fee litigation before applying.

Your job ends. The mortgage, family plans and recruiter screening questions keep coming.

Then someone sends a headline about the grace period disappearing. Someone else says a new employer must pay an enormous fee. Before sending another application, separate your actual deadline from the headlines.

Legal information checked October 15, 2026. General information, not legal advice. Confirm your status, work permission and deadlines with your DSO or a qualified immigration attorney.

What the H-1B grace period actually gives you

The deadline is a ceiling, not a guaranteed allocation of time. 8 CFR 214.1(l)(2), checked October 15, 2026, allows up to 60 consecutive days after qualifying employment ceases, or until the authorized validity period ends, whichever comes first. DHS can shorten or eliminate the period as a matter of discretion. The rule also covers qualifying dependents.
That makes the popular instruction to simply count two months unsafe. Calendar months have different lengths, and an earlier status expiration may control. The rule provides the grace period once during each authorized validity period. It does not create a fresh allowance whenever a recruiter starts a conversation. Source: current regulation.
For counting only, treat the day after the confirmed employment end as the first day to review. USCIS’s archived FAQ, last updated January 24, 2025, describes that starting point and the last day for which salary or wages are paid. Because the FAQ is archived, use the current regulation and counsel’s assessment of the actual arrangement rather than relying on it alone.
Use the H-1B grace-period calculator to organize dates, then have counsel confirm them. A calculator cannot decide whether discretion applies or whether a particular employment arrangement continued.
Key Takeaway

Establish the end of employment and the authorized validity period before treating a calculated date as your immigration deadline.

H-1B layoff: what to do first

The first useful document is your employment timeline. Save the termination letter, recent pay statements, H-1B approval notices, current I-94, passport information and any documents concerning dependents. Keep copies somewhere you can access after company accounts close.

Ask HR to distinguish the notice date, last day of employment and any severance arrangement. A bank deposit date does not establish that employment continued until that date. The regulation turns on cessation of employment, so ask your attorney how salary continuation, garden leave or a disputed termination date affects your facts. Source: 8 CFR 214.1(l)(2), checked October 15, 2026.
Suggested HR request:

Please confirm my employing legal entity, the effective end date of my employment, whether any paid notice period continues the employment relationship, and the immigration team's contact details. Please provide copies of immigration notices and explain any planned petition withdrawal.

This is a document request, not an argument about severance. Keep compensation negotiations on a separate track so an unanswered benefits email does not delay your immigration review.

For the broader financial and job-search checklist, use the layoff recovery plan. For application support aimed at your status, see the H-1B search service.

Does a transfer have to be approved before the deadline?

A signed offer is progress. It is not a filed petition.

Under the portability regulation, an eligible H-1B worker can start new employment upon proper filing of a nonfrivolous H-1B petition, or the requested start date, whichever is later. Eligibility includes having been admitted or provided H-1B status, a qualifying filing requesting an amendment or extension of stay before the authorized period expires, and no unauthorized employment since the last admission through filing. The employer's lawyer must evaluate those conditions. Source: 8 CFR 214.2(h)(2)(i)(H), checked October 15, 2026.

Do not convert that into a promise that every person laid off can start on a receipt. Prior cap history, expired documents, earlier filings and status changes can change the analysis. Ask counsel to distinguish a job offer, LCA preparation, petition filing and the lawful start date.

Search milestoneWhat to verify
Recruiter says transfers are supportedDoes this requisition and legal entity have approval?
Hiring team wants to make an offerHas immigration counsel reviewed your dates?
Offer is signedWho owns petition preparation and filing?
Petition is being submittedWhat evidence confirms proper filing, and when may work begin?

This is a planning table, not a filing timetable. Build room for the employer's own approvals and document requests rather than relying on a last-day delivery.

Can you work, freelance or take a bridge job?

The grace period itself does not authorize work. The regulation expressly limits employment during the period unless otherwise authorized. A consulting project, unpaid trial or cash-paid bridge job should not be treated as a harmless workaround. Have counsel review any proposed work before it begins. Source: 8 CFR 214.1(l)(2), checked October 15, 2026.
A move into cap-exempt H-1B employment can be worth exploring, but cap exemption does not replace a petition or resolve your start-date requirements. Likewise, a spouse's valid work permission is different from your own. Read the H-4 EAD jobs guide if a dependent-status option is relevant, then confirm eligibility with counsel.

Be precise with recruiters: explain the kind of petition support needed, your counsel-confirmed filing window and whether a start date remains subject to immigration clearance. That is more useful than saying only that your visa is valid.

The September 2025 $100,000 proclamation and 2026 litigation

Do not reject a potential employer because someone forwarded a fee headline. The documents describe different actions.

  • September 19, 2025: Proclamation 10973 introduced an entry restriction involving a $100,000 payment for covered H-1B petitions, effective September 21, 2025, with stated exceptions. Its text addresses workers outside the United States; it is not a universal personal charge on everyone holding H-1B status.
  • September 18, 2026: Proclamation 11069 extended the restriction for another year, through September 21, 2027, and addressed admission needed to effectuate covered approvals.
  • September 30, 2026: the court in Global Nurse Force v. Trump, Document 130, pages 2-3 and 34 described the earlier Massachusetts vacatur and the First Circuit's refusal to stay it. The California court also vacated and remanded the agency policies and enjoined implementation under both proclamations until the specified administrative procedures are conducted.
The September 30 order bars implementation of those agency fee policies until the specified procedures are completed. The court also denied the government’s request to stay its relief pending appeal. These statements describe that dated order, checked October 15, 2026; they do not establish the outcome of later proceedings. A proclamation remaining on the White House website does not settle collectability. Employer counsel should check subsequent docket entries and current filing instructions immediately before filing. Source: order, pages 33-34.

Ask the employer: “Which current fee requirements apply to this particular petition, and has counsel checked the court orders?” Do not send money to a recruiter claiming a personal payment will reserve a transfer.

Later proposals are not current filing requirements

There are separate rulemaking tracks. Keep their dates attached to the claims.

DocumentWhat it proposesStatus described by the source
DHS, August 25, 2026A $103,265 fee for cap-subject petitions, in addition to other applicable chargesNotice of proposed rulemaking
DHS, September 11, 2026Removing the discretionary grace periodProposal; comments due November 10, 2026
DOL, March 27, 2026Revising prevailing-wage methodologyProposed rule

The source check did not establish these proposals as effective final requirements. Do not add the proposed fee to an employer's bill or plan around a proposed elimination of the grace period as though either has already taken effect. Recheck official sources when making a filing decision.

Build a search around filing feasibility

A long employer list is useful only after eligibility screening. Use the H-1B sponsor directory and the company-selection guide to find historical leads. Past filings do not confirm sponsorship for today's opening.

Create a short record for each live role: posting URL, legal employer, job family, location, transfer policy, recruiter contact, interview stage and immigration review owner. Keep an “unknown” field when sponsorship has not been confirmed. Do not let a matching algorithm silently turn unknown into yes.

A practical daily routine is to review new suitable openings, request warm introductions, follow up on active interviews and clear document requests. These are search habits, not legal deadlines. Reserve time for interviews rather than spending the entire day completing similar forms.

For an initial recruiter message, use:

My background is in [role and specialty], with experience in [relevant systems or domain]. I am seeking an H-1B change of employer. Before scheduling, can you confirm whether this requisition supports that process and connect me with the appropriate immigration contact?

Keep the immigration detail accurate and the professional pitch concrete. Panic is understandable; a readable request still works better than a long account of the layoff.

What if an offer will not arrive in time?

Start this conversation before the deadline becomes imminent. USCIS's December 19, 2022 options bulletin describes possible changes of status, other employment-based options and departure. Availability depends on the person's circumstances.
A timely, nonfrivolous change-of-status request may have implications for authorized stay and unlawful presence. It does not automatically authorize employment in the new category. USCIS specifically distinguishes those questions in the bulletin. Do not treat a visitor-status filing as permission to continue working while searching. Source: USCIS bulletin, change-of-status sections.

For an Indian national with an approved immigrant petition, counsel should also review the consequences for dependents and longer-term immigration plans. An approved immigrant petition is not a substitute for current work permission. Bring the actual notices rather than relying on a recollection of what an earlier employer filed.

Different status, different clock
F-1 OPT readers need the OPT unemployment-days rules, including the separate STEM requirements in the E-Verify employer guide. New graduates can start with jobs for international students.
Before you apply
  1. 01Confirm your employment end date, I-94 and petition history with counsel.
  2. 02Ask employers about this requisition and proper filing, not just a general sponsorship policy.
  3. 03Keep court orders, proclamations and proposed rules separate.
FAQ

Can severance extend my H-1B grace period?

Do not assume it does. The rule turns on cessation of employment, not the date a severance deposit arrives. Ask counsel to evaluate the actual employment and payment arrangement. Current regulation, checked October 15, 2026.

Can I get another grace period after changing employers?

The regulation allows the discretionary period once during each authorized validity period. A new approved petition can involve a new validity period; counsel must assess your actual notices and history. 8 CFR 214.1(l)(2).

Do OPT workers get the H-1B layoff grace period?

F-1 post-completion OPT has its own unemployment rules. It is not listed among the employment classifications covered by this grace-period provision. 8 CFR 214.1 and 214.2.
